Subscription Service Terms of Use
“Learn How To” is an affiliated sister school of ACS Distance Education.
These Terms of Use are important and govern your use of our service. Please read this carefully. Terms of Use are subject to change without notice. Since you are bound by these Terms of Use, you should periodically refer to this web document to monitor changes. These Terms of Use are subject to jurisdiction of the Consumer Rights Act in the UK.
Upon subscribing to “Learn How To” (the college), you ("the subscriber" or “subscribing organisation”) are entering a legal agreement under common law. You hereby agree to abide by the Terms of Use of our subscription-based service, in exchange for the service during the period in which you are a subscriber to our service. Our service is defined as all content accessed via “Learn How To’s” online delivery platform and this website, including all features, functions and educational content accessed.
It is the subscriber’s responsibility to fully read, understand and agree to all Subscription Terms of Use and our Privacy Notice upon subscribing. By agreeing to these Terms of Use, the subscriber confirms they possess a full understanding of all Terms of Use, and willingly accepts all such terms.
THE SERVICE – Personal Subscription Based Learning
There are two types of subscriptions:
1. Individual subscription which is an agreement (contract) between “Learn How To” and the individual subscription (service user)
2. Organisational subscription which is an agreement (contract), between “Learn How To” and an organisation (service user)
Organisational subscription provides access to the service for a designated number of individuals who are employees, members, or otherwise professionally associated with the organisational subscriber.
Employees, members or otherwise professionally associated individuals using the service under an organisational subscription are required to adhere to the Terms of Use outlined herein. Each user’s agreement is activated via an Organisational Subscription and remains the sole responsibility of the Organisation itself. To enter the agreement as a subscriber, you must provide us with a payment method. Payment of a subscription allows access to all courses offered by “Learn How To” for the duration of the subscription and only whilst monthly payments are being made. Once registered as a user, your subscription will continue until terminated by “Learn How To”, or by you “the subscriber”.
Subscriber Age Restriction
Subscriptions will only be accepted for individuals aged 18 years and over. Organisational subscriptions may include users under the age of 18 years whereby the service user is not making financial payments directly to “Learn How To”. “Learn How To” will not accept payment from users under 18 years.
INTELLECTUAL PROPERTY AND COPYRIGHT
All information, text, material, graphics, software and advertisements on the site (“all content”) are protected by Australian and International intellectual property rights, copyright and trademark laws. “Learn How To” content is specifically the intellectual property of ACS Distance Education and is subject to ACS Distance Education’s copyright terms.
Under no circumstances, can content can be reproduced, republished, sold, loaned or copied, or used in any way outside the pursuit of learning by the subscriber, without explicit permission granted in writing by “Learn How To”. Action may be taken against any individual or organisational subscriber found in breach of this contractual clause.
ACCESS AND USE OF THE “LEARN HOW TO” Website
To use the service, you require internet access.
Use of, and access to the “Learn How To” website is conditional upon acceptance of and compliance with these Terms of Use found here.
As a condition of use of this website, you agree to not use the site or its content and materials for any unlawful purpose, or in any ways prohibited by these Terms of Use. “Learn How To” gives no endorsement, accepts no responsibility for, and will not be liable for, any third-party links.
If you become aware of misuse of the site by any person, please contact “Learn How To” with your concerns.
“Learn How To” software is developed by, or for, “Learn How To” and is designed to enable use of content from the “Learn How To” learning portal (course delivery system). You acknowledge the use of “Learn How To’s” service may require your use of third-party software also and that itself is subject to user agreements and licences.
LEARNING OUTCOMES, EDUCATIONAL CONTENT AND COURSE COMPLETION
Subscribers are responsible for their use and maintenance of acquired knowledge. “Learn How To” takes no responsibility for, and will not be liable for, any action or claim in connection with, or arising from, any such information, instruction or advice given by any subscriber or former subscriber. “Learn How To” takes no responsibility for and will not be liable for the subscriber’s own interpretation and/or misuse of content.
Every attempt is made to ensure all information provided by “Learn How To” is accurate, and a subscriber has attained all competencies taught within a course, at the time of assessment.
On successful completion of the online self-assessment, at the conclusion of a course, with a pass rate of 80% or greater, an electronic achievement badge is given as proof of completion. The subscriber is responsible for ‘saving’ such achievement badges and/or maintaining personal records of which courses have been undertaken. “Learn How To” does not track or store any subscriber’s learning history, completion records, nor will “Learn How To” reissue electronic achievement badges to subscribers.
Where the service is being used for training and development in organisations, Organisational Subscribers are encouraged to set up a means of tracking users engaging with the content. “Learn How To” does not track user engagement.
BILLING, REFUNDS AND CANCELLATION
Billing
When you register for the service, you authorise us to immediately charge the subscription fee for the first billing cycle to your payment card. For your convenience, payments are automatically deducted every 30 days from your card/account on an ongoing basis until you cancel the service.
There are no deferments, extensions or transfers applicable.
Refunds
We will give consideration for requests to refund if you are unsatisfied with this service or in certain circumstances. Please email us with the details and we will respond to your request.
No refunds will be given if the service is working and functioning as described on the website.
No refunds are given for a situation which is not within the control of “Learn How To” such as:
- You, the “subscriber”, have changed your mind or decided you did not like the purchase or had no use for it.
- You insist on receiving the service in a way which is not compatible with our delivery system.
- You have failed to recognise or comprehend the terms of the service at the time of registering as a user.
- If the issue is beyond our control.
In any circumstance where a refund is applicable, this will only be issued via the original method of payment and to the named subscriber. To request a refund, please contact us at: hello@learnhowto.co
Cancellation
You may cancel your subscription to “Learn How To” at any time. You can cancel your subscription via the website. Subscribers wishing to cancel the service may do so prior to the start of each monthly subscription period/billing cycle to avoid being charged for the next billing cycle. Unless you cancel your subscription before your billing date, we will continue to deduct your monthly payment from your chosen payment method. Please allow sufficient processing time when cancelling your subscription.
PRIVACY AND DATA
“Learn How To” operates a strict Privacy policy and information management procedure to protect your information and any data we hold. We store information securely; it is used in accordance with our privacy policy. Please refer to our Privacy notice for full details.
Data we hold is used for the purpose of supplying the service, however if you would like “Learn How To” to remove any information we may hold, please contact our privacy officer and we will process this hello@learnhowto.co You should note this may result in the termination of your subscription.
